Superfund Connectedness: If Butte doesn't flush, Missoula doesn't drink...

When it comes to America's Largest Superfund Site here in the Upper Clark Fork River Basin of Montana, we are all together in a very big lifeboat. By "we," I mean residents of Butte, Anaconda, Opportunity, Deer Lodge, Bonner/Milltown, Missoula, and surrounding areas. It's like the traditional union slogan, "An injury to one is an injury to all." This is also true in an environmental sense, of course. As some like to say in Butte, "If Butte doesn't flush the toilet, then Missoula doesn't get a drink of water."

Lately, I've been staying out of the springtime blizzards and reading through hundreds of pages of monitoring reports on Silver Bow Creek—that little stream that flows from Butte at the headwaters of the Clark Fork River. Silver Bow Creek -- technically known as the Stream Side Tailings Operable Unit -- was one of the first sites to be addressed by Superfund in the Upper Clark Fork River Basin. Furthermore, Silver Bow Creek is an excellent example of Superfund remedy integrated with restoration, with the state of Montana (rather than the EPA) taking the lead.

Thanks to Montana’s Natural Resource Damage Program, the Department of Environmental Quality (DEQ) is spending several million dollars per mile to cleanup and restore 24 miles of Silver Bow Creek. The flood plain is dredged to remove stream sediments high in arsenic and toxic heavy metals, the stream is reconstructed to function as a stream should, clean soil is spread along the corridor, and the area is revegetated with native plants and shrubs.

To the eye, the area looks pretty darned good, especially when you compare the "before:"

It's disturbing, though, to learn that the remedied and restored creek is being recontaminated.

Initially, when I heard about the recontamination of Silver Bow Creek, I thought it might be an ephemeral problem stemming from recent work along Butte’s old Metro Storm Drain. The DEQ site supervisor assured me it's not a big problem.

Data show, however, that this recontamination has been occurring since monitoring began in 2002. And it sure looks like a big problem, with contaminant levels far higher than threshold levels that indicate impairment of aquatic life. For example, the threshold for copper in sediments is about thirty parts per million. Contamination levels routinely exceed this threshold by a factor of ten, and occasionally by a factor of one hundred. Geez, if Denny Washington hears about this, he’ll start mining Silver Bow Creek!

After five years of reports confirming recontamination, you’d think DEQ and EPA would do something. Data indicate that recontamination is steadily occurring. Yet, each year, the annual review concludes with the recommendations: collect more data; try to identify the source; wait and see.

What, exactly, are we waiting for? We know that under remedy many sources of contamination on the Butte hill will remain. Furthermore, completing that remedy is some years in the future. Finally, a solution to this recontamination problem is already on the table: EPA included treatment ponds as an option in the Butte hill remedy. Let’s build that treatment facility now, and stop the madness.

In a very real, physical sense, the headwater stream of Silver Bow Creek is connected with the main stem of the Clark Fork River. Water flows down hill.

Every clean up has its price: sometimes in dollars and sometimes in human terms. With the clean up of Silver Bow Creek, Milltown, and other Superfund sites in the Upper Clark, let’s not forget where all that toxic mine waste goes. No, it doesn’t magically disappear.

Here we have a case of social (and environmental) effects moving upstream.

The toxic mine waste from Milltown is hauled up river to the vast Arco-British Petroleum waste repository near the town of Opportunity. Charlie Coleman of the EPA conducted a group tour of CRTAC and Opportunity activists on the repository last week. It was formerly known as the Opportunity Ponds, and for many years the Anaconda Copper Mining Company dumped waste there from its Anaconda smelter.

It’s a big site: four thousand acres; more than six square miles. To date, the Arco-BP waste repository has been a big problem for nearby residents. Much of the waste was so phytotoxic that it would not support ground cover. Arsenic and heavy metals were carried off by wind and water erosion. Huge dust storms still occasionally engulf the town of Opportunity.

The day we visited, Arco-BP’s waste repository was a beehive of activity. Dennis Washington’s Montana Rail Link hauls waste by the trainload from Milltown, and Washington’s EnviroCon company spreads this waste as topsoil and undertakes revegetation. The 2.2 million cubic yards from Milltown – that’s about a million pickup loads – will cover a third of the waste repository.

EPA believes that the arsenic and metals levels of the Milltown waste, while high enough to classify as toxic waste, are low enough to support vegetation at a highly toxic waste repository currenlty devoid of vegetation.

Much of the waste repository has already been revegetated using contaminated soils from Silver Bow Creek. For the most part, says Charlie Coleman, the vegetative standard of 30% cover appears to have been met [see note, below]:

Some areas are pretty sparse, and if necessary will receive additional topsoil and reseeding:

Hopefully, this vegetative cover will end the dust storms, erosion, and further contamination of the groundwater aquifer.

Opportunity is a beautiful little town, and residents worry about being so close to a corporate waste dump. Some are more than a little skeptical about EPA assurances that this toxic waste in their backyard will be safely contained. They also do not trust EPA assurances that the arsenic action level of 250 parts per million is safe. Ninety Opportunity residents recently filed a lawsuit against Arco-British Petroleum, claiming that the corporation has “recklessly jeopardized their property, health, and welfare.”

The lesson here is that in Superfund, as in all things, we are connected. What happens along Silver Bow Creek will affect the Clark Fork River, and what happens at Milltown will affect the town of Opportunity. Let us all praise the Milltown Dam removal and cleanup, but let us also support Opportunity in its quest for environmental justice.

Note: I readily confess that I do not know my butt from a hairy hole in the ground (sorry for the unfortunate analogy, but we are talking about a toxic mine waste site here!) when it comes to revegetation standards. Charlie Coleman, EPA, explained that they are using a Montana State University-Bozeman yardstick called "LRES Standard." The 30% goal must be met within ten years.

Clark Fork Superfund: If You Fail to Plan, You Plan to Fail?

Springtime in the Rockies. Another St Paddy’s Day in Butte is behind us. Butte’s Silver Bow Creek is rising as snow pack melts under the warm afternoon sun. Normally, we like to see those high spring flows. They are part of a natural cycle for our streams, and beneficial effects range from creating spawning habitat for trout to stimulating cottonwood seed germination.

In the case of Silver Bow Creek, spring run-off is not so good. Recall that Montana’s Natural Resource Damage Program (through the Department of Environmental Quality or DEQ) is spending about three million dollars per mile to cleanup and restore 24 miles of Silver Bow Creek. Much of this money is for dredging and removing stream sediments high in toxic heavy metals. You know, from the days when the Anaconda Copper Mining Company used the environment as a free garbage dump.

Recently released data show that Silver Bow Creek is being recontaminated—probably by run-off from the Butte hill. It’s not that spring run-off is to blame, exactly. Rather, it is Arco-British Petroleum and the Environmental Protection Agency.

It’s a serious problem. Copper is a good proxy for all of the other heavy metals and arsenic that are part of this recontamination problem. According to EPA, the maximum “safe” ecotoxicity level for copper in stream sediments is 34 milligrams per kilogram. The copper levels of recently deposited sediments in Silver Bow Creek are running ten to thirty times the safe level.

Joel Chavez, the Superfund Project Manager for DEQ, explained to me that this is not necessarily as bad as it looks. The arsenic, copper, and other heavy metals are concentrated in the fines (very small diameter) portion of the creek sediments, and the fines make up a relatively small overall proportion of the total sediments. Therefore, the overall proportion of contamination is fairly low.

Still, copper is toxic to most aquatic life. Recontamination -- especially if it continues in a chronic manner -- could prevent trout from recolonizing the creek and impair the kinds of critters that trout eat. Re-establishing trout populations is a major goal for the restoration of Silver Bow Creek. Recontamination might mean failure for remedy and restoration.

This single instance of recontamination is one sign of a broader failure with two main parts: one is a fundamental problem with the upper Silver Bow Creek and Butte hill remedy; and the other is a fundamental problem with public communication and involvement.

Over the past decade or so, EPA assured us that recontamination would not occur. Problem is, instead of cleanup, EPA prefers long-term institutional controls—complex engineering solutions such as settling ponds and trenches to intercept and reroute toxic runoff. While this sort of cover-up is cheaper for Arco-British Petroleum, it doesn’t work.

What have the EPA, Montana’s Department of Environmental Quality, and Montana’s Natural Resource Damage Program to say about the recontamination of Silver Bow Creek? Nothing. That’s right: no public meeting, no nothing. Silver Bow Creek was cleaned up with public money. We expect government to use our money responsibly. That responsibility includes involving the public in planning and notifying us when things go wrong.

The EPA, of course, ignored public opinion regarding remedy for the Butte hill when it came to issues such as removing the Parrot Tailings.

Given the evidence that Silver Bow Creek is being recontaminated, Warm Springs Ponds are the safety net that protects the Clark Fork River. They are located at the lower end of Silver Bow Creek, just before it joins Warm Springs Creeks and other tributaries to form the Clark Fork River. The ponds are a popular recreational area for anglers, bird watchers, bikers, hunters, and waterfowl dog trainers.

CFRTAC has been working with the state to improve management at the ponds. There is serious neglect: toilets are a wreck, personnel have been cut, trash cans overflow, and facilities such as boat ramps and picnic tables are in disrepair. Montana Fish, Wildlife, and Parks has incorporated many of CFRTAC’s concerns into a proposal for funding from the Natural Resource Damage Program (NRDP).

As an outcome of its recent 168 million dollar settlement with Arco-British Petroleum, the Natural Resource Damage Program has released plans for the Butte hill and Clark Fork River.

The Butte plan proposes removing the Parrott and Metro Storm Drain tailings at a cost of about 26 million dollars. EPA should have required this under remedy, and it will help insure the long-term environmental health of the watershed.

Montana will also be the lead agency for the 104 million dollar Clark Fork River remedy, thus enabling it to integrate remedy and restoration.

Despite this good news, CFRTAC’s overarching concern remains: there is no comprehensive restoration plan for the Upper Clark Fork River Basin. The state needs to involve the public in developing a plan that identifies and prioritizes restoration needs as a guide for decisions about which projects get funded. Carol Fox, director of the NRDP, assures me that there is a process underway to develop such a plan.

Giving Thanks for Environmental Activists

A version of this commentary aired on KUFM, Montana Public Radio, as part of a regular series I do for the Clark Fork River Technical Assistance Committee (www.cfrtac.org).

Elk season is over. It’s time to clean and put away the rifles. The snow is calling. Purple wax on those cross country skis will be about right.

Give thanks for Pilgrims and Indians and turkeys and elk. And thank the activists that helped bring environmental remedy and restoration to the Clark Fork watershed. Without activists, Arco-British Petroleum would have held even greater sway over the Environmental Protection Agency, and Montana’s Natural Resource Damage suit against Arco-BP might have died for lack of legislative support (i.e. funding).

Instead, Montana obtained 215 million dollars nearly a decade ago as a partial settlement. If we can believe a recent Missoulian newspaper editorial, Montana and Arco-BP will soon resolve remaining claims. Now that’s a holiday present!

The money we have received has done some good. A recent Fish, Wildlife & Parks electrofishing survey of Silver Bow Creek found significant numbers of trout. Most – including a few native westslope cutthroat trout – were found near the confluence with German Gulch. A few were found closer to Butte. Good on the Montana agencies and citizen activists that helped make this possible.

Butte’s George Grant Chapter of Trout Unlimited played a critical role, working with the Butte-Anaconda Greenway Board, insisting that the recreational project include riparian and stream enhancements. Furthermore, George Grant TU’s restoration project along German Gulch Creek – a Natural Damage Program funded project – enhances the overall restoration of our Silver Bow Creek watershed. Again, thank these activists. This stuff doesn’t just happen unless a whole lot of volunteer citizens put in a whole lot of hours at meetings, in writing grants, and on managing projects.

I’m an environmental philosopher, and believe "the glass is half full and the glass is half empty.” Retired FWP fisheries biologist Wayne Hadley cautions that we should not expect too much, too soon, of Silver Bow Creek. After all, there is a tremendous amount of toxic mine waste outside of the flood plain that is not being cleaned up, and that material may re-pollute much of the creek.

We’re in this for the long haul. I don’t reasonably expect to have good fishing in Silver Bow Creek within my lifetime. If, however, my daughter doesn’t enjoy good fishing in the creek by the time she’s my age, then my ghost will be seriously pissed. We don’t have to accept environmental degradation as "the price of progress," and we can make the world a better place.

The Natural Resource Damage Program will likely sprinkle more fairy dust around the Upper Clark Fork River Basin–about 14 million dollars worth in the coming year or so. Projects include the usual Butte and Anaconda waterline work, but also: more funding for the Silver Bow Creek Greenway; a trail and outdoor education center near Deer Lodge; and restoration work for a public park on Forest Service land near Butte.

Near Missoula, the Clark Fork Coalition should receive nearly three million dollars to remove additional contaminated sediments from Milltown–an amount over and above what the EPA requires under remedy. Ideally, the agency would have made Arco-BP pay for this. Instead, we must spend precious and limited Natural Resource Damage dollars. Still, it’s money well spent. Removing additional mine waste from Silver Bow Creek improved the creek’s environmental future, and removal of additional sediments at Milltown will do the same.

It’s not all clover and roses here in upper end of the Clark Fork River superfund site.

Those contaminated sediments from Milltown? Yep, they go to the Arco-BP waste repository in Opportunity’s backyard. Milltown sediments are a drop in the bucket compared with what’s already there. Still, how happy would you be living with a backyard toxic waste repository of 160 million cubic yards, extending over an area of more than five square miles?

There are no easy answers for questions about environmental justice at Opportunity.

A group of my students in the "Politics of Technical Decisions" class have a novel approach to this problem. They plan to stage a play using techniques developed by Brazilian, Augusto Boal. His "theater of the oppressed" is a popular tool for political dissent and public education in South America and Europe (http://en.wikipedia.org/wiki/Augusto_Boal).

The production is titled, "Too Late for Opportunity?" The short, two-act play will be staged at the Venus Rising CafĂ© in Butte, from 3 - 5 p.m., on Monday, December 10th. To help resolve problems posed in the play, audience members are invited to participate by taking the place of an actor and redefining that actor's role. We’re inviting representatives from Arco-BP and the EPA, as well as Opportunity residents and the general public.

German Gulch Restoration: thanks to the David & Lois Layton family

Earlier this week, I attended a dedication ceremony in German Gulch near Butte. The surviving family of David Luther Layton, including his spouse Lois, four children, and many grandchildren, worked with the George Grant Chapter of Trout Unlimited to insure that their family property would be forever appreciated--by the general public. By transferring their beautiful 80 acres along German Gulch Creek to the US Forest Service and Montana state lands, the Laytons became part of a grand restoration project that benefits westslope cutthroat trout, other wildlife, and the public in general.

After moving to the great city of Butte in the heart of the northern Rocky Mountains in 1990, my hear soon fell for the Big Hole River. But, that very first year, I also discovered a delightful nearby trout fishing, hiking, and mule deer hunting spot. The small stream of German Gulch, a tributary of Silver Bow Creek in the upper Clark Fork River basin, was much like the freestone mountain creeks I had grown up fishing on the Appalachian Plateau of the Allegheny Highlands
Whereas the creeks of my boyhood held native brook trout (Salvelinus fontinalis), through German Gulch creek I became acquainted with the native fish of the west--the westslope cutthroat trout (Oncorhynchus clarkii lewisi). Here's one, in the sampling tray of fisheries biologist Tim LaMarr:
Wow! Are these a beautiful fish, or what? As part of our natural heritage, a creature that evolved in this harsh post-Pleistocene landscape, they are a treasure. How lucky and bizarre, that the mine-polluted waters of Silver Bow Creek provided a poisonous barrier to prevent exotic, introduced rainbow trout (Oncorhynchus mykiss) from hybridizing the native fish in German Gulch Creek.
In fact, it's amazing that native trout survived at all in German Gulch Creek. More than a century ago, the entire watershed was clearcut and placer mined--the creek's floodplain extensively terraformed by hydraulic and dredge mining for gold. A whole series of French, German, Chinese, and out-of-work Great Depression era miners worked the creek over from the 1870s to the 1930s. To add insult to injury, Montana Fish & Game dumped thousands of stocked trout from hatcheries into the creek before 1980. And yet, physically damaged though the watershed was, "cutties" held on in the headwater tributaries and then recolonized the main creek as the riparian habitat recovered from abuse.

Lying about midway between the towns of Anaconda and Butte, the German Gulch watershed is an important local natural resource. With the ongoing remediation and restoration of Silver Bow Creek, German Gulch Creek would be an important source of native trout and clear, cold water. Local hunters, anglers, hikers, and campers also had a long historical connection to and a deep appreciation for the area. As I visited German Gulch more often and talked about it with other folks, I came to understand how important it was as public land and as relatively pristine habitat:
When I was elected president of the George Grant Chapter of Trout Unlimited (GGTU) in 2002-2003, I made German Gulch Creek a priority. As good as it was, there were some problems, threats, and opportunities: selenium pollution from a recently abandoned open-pit, cyanide heap-leach gold mine; private in-holdings within Forest Service and state land that were ripe for development; aquatic and riparian habitat that could not recover from the physical damage wrought by placer mining; the threat of rainbow trout entering the creek as Silver Bow Creek is remediated and restored; an irrigation diversion that diverted the lower creek and severed the aquatic habitat connection between Silver Bow and German Gulch Creeks; difficulty with public access to the lower creek... German Gulch Creek was an eye-opening lesson: habitat that -- on the surface -- appears to be good and secure may be a high priority for our attention and protection.

GGTU began its German Gulch project with a small "Project Development Grant" of about $25,000 that I submitted in 2002 to Montana's Natural Resource Damage Program (NRDP). The money helped us to search titles, obtain appraisals, develop a conceptual plan for stream restoration, and complete other needed planning tasks. When Josh Vincent, an environmental engineer and Montana Tech alumni, joined the GGTU board, things got a lot easier. He brought needed technical and managerial expertise to the project, as well as a personal passion and appreciation for German Gulch. We submitted a second planning grant for about $25,000 in 2003. This helped fund more needed work, such as a redesign for the irrigator's headgate and a plan to remove a road built with toxic mine waste tailings. These two planning grants laid the foundation for the more than $1 million that Josh and I raised through grants in 2004. Though the bulk of the money came from NRDP, we also succeeded in obtaining matching funds from Montana Fish, Wildlife & Parks (FWP) Future Fisheries program for stream restoration work, FWP funds for a fish barrier to halt rainbow trout introgression, US Fish & Wildlife Service Fisheries Restoration and Irrigation Mitigation Program for a fish screen on the irrigator's headgate, and Montana Fish & Wildlife Trust funds for land purchases.

David Luther Layton and his wife Lois appreciated nature and enjoyed camping with their four children. After buying a parcel of about 80 acres (several former mining claims) in German Gulch, they began a family tradition of camping there. GGTU approached the Layton family in early 2004, with an inquiry about purchasing the family's land and transferring it to public ownership. The Layton property was astride the Forest Service and state lands boundary, and so the upper portion of the property would go to the feds and the lower portion to the state.

The Layton family was gracious and patient in dealing with GGTU. David was deceased, and Lois and her other three children allowed her son Matthew to represent the family. This greatly simplified GGTU dealings with the family, but it also spoke reams about the Layton family's solidarity, trust, and general sense of good will. During this time, I moved on to some other projects and Josh Vincent took on German Gulch project management for the Trout Unlimited Chapter. German Gulch was my baby, but it was raised by Josh. As I told the Layton family at yesterday's ceremony marking the tranfer of the land, it is easy to conceive and even birth a baby. Josh did the hard work of raising the child.

The ceremony also proved to be a family reunion, including mother Lois and other family elders, gathered here around "rally rock" on the Layton property: Children David, Daniel, Sue, and Michael and their spouses:
And the grandchildren and the whole gang, along with some GGTU folks: We capped the ceremony with a hike down to the bridge crossing for a public trail constructed as part of the project. Here is Andrew McElroy (Boy Scout Troop 8 of Butte, Montana) with the bridge he helped design and build as his Eagle Scout project: And here is Josh Vincent (left), the good parent who has brought this project along to date, and who remains committed to the many other tasks yet to be completed: As Hillary Clinton famously wrote, "It takes a village to raise a child." Similarly, it takes a village to pull off a grass-roots based project of this magnitude. At the risk of offending some persons by forgetting to mention them, it is important to recognize some of the key supporters of and participants in this project.

First of all, the whole Layton clan: Lois, son David Michael and his spouse Robin, son Daniel Dana and his spouse Jane, daughter Sue and her spouse Eckelhardt Schulze, and son Matthew Steven and his spouse Christiane.

Next come fisheries biologists Tim LaMarr and Ron Spoon. Tim worked for the Forest Service at the time, and had been working for several years to survey native westslope cutthroat trout in German Gulch and to persuade his agency to invest in restoration. Ron is with FWP, and has worked tirelessly to assess and protect native trout populations throughout southwest Montana.

Kriss Douglass, a local FWP employee (now retired), early on appreciated the promise of GGTU's project, and helped convince her agency that it should be a priority. After Kriss' retirement, Vanna Boccadori supported the project and marshalled important tasks such as the required environmental assessement.
Hugh Zackheim at the FWP land's office worked closely with Josh Vincent on the title documents and other difficult tasks.

There were many others, some whose story is yet to be told. The rancher and irrigator with the water rights to German Gulch Creek has been as patient and generous as the Layton family in his dealings with GGTU. As the reconstruction of his headgate and irrigation diversion takes place, I look forward to continuing this story.

In the late 1990s, when I and a few others first began brainstorming a German Gulch restoration plan, no one could have imagined how much work it would entail nor how long it would take. My hat is off to Josh Vincent and his colleagues at George Grant Trout Unlimited for their dogged persistence in seeing this project through to its completion.

Warm Springs Ponds: the future of a Superfund site

The three Rs of Superfund : “Reclamation, Remediation, and Restoration.”

If we go by the book, the three Rs have distinct definitions. Reclamation is the broadest term—something like a genus in biology. You know, like the genus “Canis,” which takes in wolves, dogs, and coyotes. Reclamation is a fuzzy notion.

Mining engineers define reclamation as “returning damaged land to a beneficial use.” British Petroleum-ARCO likes to call itself a “partner in responsible reclamation.” As the legally responsible party in the Clark Fork Superfund mess, BP-ARCO is responsible for a lot more than reclamation! But if BP-ARCO can pull off a cheap reclamation job that masquerades as remedy, it will do that. Look at the golf course or all those ball fields built on mine dumps.

Remedy is defined under federal Superfund law as the “removal or treatment of hazardous material to protect human and environmental health.” The removal of toxic mine waste along Silver Bow Creek is remedy. EPA oversees remedy, and the decision that makes it official is called a Record of Decision.

Restoration is a legal term defined under the state version of Superfund law as “returning injured natural resources to baseline conditions or otherwise accelerating the natural recovery process.” The construction of a functioning streambed and planting native vegetation along Silver Bow Creek is restoration. Montana oversees restoration.

My student, Michelle Sullivan, recently completed an undergraduate research project about the three Rs. Michelle interviewed federal, state, industry, and academic experts.. Surprisingly, half of these experts were as confused about the three Rs as were members of a lay audience.

Well, the real world is a complex place that simply does not easily conform to the language we invent in order to describe it. The intentional obfuscation of terms by BP-ARCO doesn’t help, either. Nor does the complicity of the EPA in allowing BP-ARCO sometimes to count superficial reclamation – i.e. cover-up – as remedy.

Still, the world is a complex place. Consider Warm Springs Ponds—2500 acres of beautiful, lush habitat along I-90. Despite appearances, the area is an industrial waste treatment facility for the polluted waters of Silver Bow Creek. Construction began in 1911, and work continues to this day. For example, in the early 1990s, ARCO removed more than 500,000 tons of contaminated sediments. And there are millions and millions of tons still in place—an amount probably exceeding what’s at Milltown. Furthermore, the concentrations of arsenic and other toxic metals are far higher than at Milltown.

Warm Springs Ponds faces an uncertain future. EPA, Montana, and BP-ARCO all have their fingers in the pie. EPA has not specified a remedy – or Record of Decision – for the area. In part, this is because remedy and restoration of Silver Bow Creek will take another decade or so.

Should remedy and restoration on Silver Bow Creek exceed all reasonable expectations and should the creek actually meet water quality standards, Warm Springs Ponds might no longer be needed for waste treatment. One could imagine a radical solution such as bulldozing the ponds back to the hillside in a vast dry-closure waste repository. Or, a trickle of water could be maintained over the ponds as a wet waste repository. Or, the ponds could be maintained very much as they are today.

Consider this last option—maintaining Warm Springs Ponds in perpetuity. There’s a good argument for this. Hundreds of resident and migratory birds depend upon the area; and it’s home to upland game and trophy trout. On a walk around the ponds last weekend, my family and I thrilled at the site of osprey snatching fish, sandhill cranes dancing and hooting, and Canada geese guarding their fuzzy yellow offspring. The area provides important recreational opportunities for bird watchers, anglers, waterfowl hunters, and dog trainers.

Warm Springs Ponds will not take care of themselves. Maintaining the natural resources and recreational opportunities will cost money. Toxic muck will need to be dredged periodically and hauled to a repository, the ponds’ dikes will need to be monitored and kept safe against erosion, and trails and signage will need to be maintained. For these reasons and others, the future of the area must be secured--perhaps with an operations and management trust fund, something like the $50 million stash that Butte received from BP-ARCO for assuming oversight of the Butte Priority Soils remedy.

Recently, a diverse group of conservationists came together to deliberate this issue. Citizens included representatives from groups such as Trout Unlimited and the Montana Wildlife Federation as well as interested local folks. We do not yet know what the future will bring, but we do want to play an active role in shaping it. We don’t want reclamation masquerading as remedy.

An Opportunity for Arsenic Reduction

In the Superfund process (as in life itself), the naming of things is tremendously important. Some might argue that naming is an arbitrary matter. Take cats, for instance. What’s the difference if I name my cat Gumbie, Rumpelteazer, or Gus? Well, as T.S. Eliot taught us, “The Naming of Cats is a difficult matter…” After all, like Adam in Genesis, we construct our world through the act of naming. Names create the roadmap for reality.

I think it was Joseph Kinsey Howard who first referred to the Anaconda Copper Mining Company as Montana’s Cheshire Cat: long after the cat was gone, it’s malevolent grin lingered in the Montana Power Company, the Plum Creek Timber Company, and of course ARCO and now British Petroleum-ARCO.

The little town of Opportunity between Anaconda and the Clark Fork River is inscribed with the Cheshire Cat’s grin; Opportunity residents are especially sensitive to the act of naming. For many years an area near their town was a toxic waste dump for the Anaconda Company. After the Company merged with ARCO and ARCO began Superfund clean up, this area became the toxic waste repository for other Operable Units—including Silver Bow Creek and Milltown Dam. Unfortunately for Opportunity residents, the ACM’s big cat box was named after their town.

Opportunity residents now ask that this waste repository be renamed the British Petroleum Ponds. The county’s chief executive Rebecca Guay says, “We’re just asking that whoever owns the ponds take ownership of them.” As Opportunity resident George Niland explains, “When people type in ‘Opportunity’ on Google we’d rather have them go to Opportunity, Montana, than the Opportunity Ponds.” [See the Montana Standard article, http://www.mtstandard.com/articles/2007/03/20/anaconda/hjjcjghjjijjgg.txt]

Renaming the ponds is a reasonable request. British Petroleum should take ownership of its own toxic waste—both through the Superfund process and through the name of its repository. We hope that British Petroleum-ARCO and the Environmental Protection Agency listen.

As another act of naming, consider the safe human exposure limit for arsenic. In Anaconda and Opportunity, the so-called “safe” residential arsenic level is 250 parts per million.

Recently, epidemiologists have proven arsenic far more harmful to human health than previously thought. In the well-known Dartmouth study that helped reduce arsenic limits for drinking water, scientists called arsenic a vitamin that promoted cancer growth. Recently, Anaconda-Deer Lodge County government has hired technical advisor Jim Kuipers. We hope that local residents can use this sound technical advice and pressure the Environmental Protection Agency to be more protective of human health. Since Opportunity residents rely on well water, it is especially important that they take advantage of the ground water testing program recently implemented for their town.

Anaconda’s residential arsenic levels were set in a study performed nearly two decades ago. Some environmental toxicology classes use Anaconda as an example of a poor human health study. According to environmental engineer Stacie Barry, who also worked on an EPA-funded study of arsenic in family pets, the Anaconda study routinely underestimated the bioavailability of arsenic through the gastrointestinal tract, skin, and inhalation. Arsenic in attic dust was ignored. Long-term residential exposure was based on a two-week study of six newborn piglets eating yard soil. The piglet study neglected the long-term accumulation of arsenic in the bones and livers of real, human children.

When one compares Anaconda with the nation, the situation looks far, far worse. Nationally, Anaconda’s arsenic levels are an order of magnitude – ten times higher – than other sites. A review of state-by-state cleanup levels for soil arsenic in residential areas shows that many are in the 10 to 20 parts per million range. This makes sense, given the Environmental Protection Agency’s recent reduction of the arsenic limit in drinking water from 50 to 10 parts per billion.

Most all of the arsenic in the Clark Fork Superfund Megasite came from Anaconda Company smelting operations. One would think that with this common source – and with the same agency now cleaning up the sites – arsenic exposure limits would be the same throughout the Megasite.

Not so: along the Clark Fork River, the safe limit for soil arsenic levels is 150 parts per million; at Milltown, sediments are considered “highly contaminated” and will be removed when arsenic levels exceed 100 parts per million; however, in Anaconda and Opportunity, soil arsenic levels are set far higher—at 250 parts per million.

What the heck is going on here? Why are Anaconda residential arsenic levels set twice as high as those at other Clark Fork sites? Far more people are exposed to arsenic in Anaconda than along the river or at Milltown.

This appears to be a serious case of social injustice. Is it OK to increase the cancer risk for Anaconda kids in comparison with Milltown kids? Or for Montana kids vs. New York kids?

Environmental Clean-up and Social Restoration

Winter is settling in over the upper Clark Fork. We have put the hunting rifles away and it’s time for the Thanksgiving/Winter Solstice/New Year’s round of parties and feasts. With the major Superfund decisions behind us, it’s also time to pause and think about where we are at in this environmental process.

All across America, people are beginning to link environmental clean-up with cultural renewal. Like grief, we seem to experience this process in stages. First there is denial: “Say it ain’t so, Marcus! Surely Butte will always be the richest hill on earth?” Next, there is industrial-history-as-Toxiland-theme-park: “OK, kids, let’s ride the roller coaster at Copper Mountain, and then we’ll head over to the Mine Tunnel of Terror.” At some point, reality takes over. We are indeed living in a post-industrial world, and the future will not look like the past.

Butte, I think, is tottering at this point. It’s a scary place to be. We need to cope with whatever second-rate clean-up we get from EPA and Arco, beg for a few more scraps, and spread scarce dollars over a big landscape.

EPA is allowing Arco to leave most toxic waste in place—you know, “cover it up” instead of “clean it up.”

Most waste will be capped and then protected with fencing and other institutional controls. These postmodern fields will be a monument to our industrial past, and must be protected and maintained in perpetuity.

Toxic house and attic dust will be cleaned up on a limited basis, and only if home owners insist. Never mind the routine roofing, rewiring, and attic renovation jobs that go on everyday and cause toxic exposure for contractors and residents.

Only time will tell whether Butte’s cultural renewal can take place despite such limitations.

Butte-Silver Bow will likely get a few more scraps from its side-deal with Arco. In exchange for the county’s complicity in the proposed Superfund remedy, the county gets 49 million dollars for things like historic preservation, health studies, and the in perpetuity treatment of contaminated water and maintenance of waste caps. The county hopes to make a million dollars or so per year as interest, available over the next one hundred years. Some of this money will be available for redevelopment.

Like the money available from the state’s Natural Resource Damage Program, these Arco trust fund dollars could be used for cultural renewal.

A new citizen’s group, the Butte Restoration Alliance, is forming. The group will advise Butte-Silver Bow government on projects for the community.

We should maintain a healthy critical attitude toward this process. Projects funded by the state’s Natural Resource Damage Program might give us a model of what to expect. Projects have fallen roughly into three categories.

In the first category, we simply fix the leaky pipes left by a century of corporate neglect. New waterlines for Butte and Anaconda fall under this category.

In the second category, we enhance public access to natural resources. The Butte-Anaconda greenway and Milltown pedestrian bridge fall under this category, as do acquisition projects that convert private holdings to public amenities. By simply connecting people with nature we hope to restore an appreciation for and the use of natural resources.

In the third category, we actually restore damaged resources. Projects that rebuild streams to function naturally and support native fish are a fine example of this. Instead of regarding nature as an economic resource to be converted into dollars, nature is a sustainable resource—something that we can become a part of without wrecking or significantly altering. There have not been many such projects.

But here we have a key criterion for authentic environmental restoration and cultural renewal: sustainability. If our activities impoverish the local ecosystem or if our restoration of natural resources requires heavy-handed maintenance in perpetuity, then we have failed at our task. A restored culture will require citizen participation and educational programs, as well as day-to-day activities wherein we live our goals. Shopping at the local farmers’ market, catching a wild trout in the river that runs through it, and attending the local arts festival: all are simple but tangible indications that environmental restoration and cultural renewal are succeeding hand-in-hand.

The twentieth century was the era of non-sustainable industrial growth and environmental pollution. Let this new century be the era of restoration and renewal.
